1. Acceptance of Terms

By accessing or using Mesa (“mesacall.com”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services. These terms apply to all users, including restaurant owners, staff, and guests making reservations.

2. Description of Service

Mesa provides AI-powered restaurant reservation management and phone answering services. Our platform enables restaurants to manage reservations, receive AI-assisted phone calls, and communicate with guests via SMS. We offer two service tiers: Full Reservations (complete reservation management) and AI Phone Assistant (call handling and reservation intent capture).

3. User Accounts

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must be at least 18 years old to create an account
  • One person or entity may operate multiple restaurant profiles
  • We reserve the right to suspend or terminate accounts that violate these terms

4. Restaurant Owner Responsibilities

As a restaurant owner using Mesa, you agree to:

  • Provide accurate restaurant information (hours, capacity, contact details)
  • Honor reservations made through the platform
  • Keep your restaurant settings and availability up to date
  • Comply with applicable laws regarding customer communications and data handling
  • Not use the service for any unlawful or unauthorized purpose

5. Guest Terms

When making a reservation through Mesa, you agree that:

  • You will provide accurate contact information
  • You may receive SMS messages regarding your reservation (confirmations, reminders, updates)
  • You can opt out of SMS at any time by replying STOP
  • Your information will be shared with the restaurant for the purpose of fulfilling your reservation
  • Phone calls to Mesa-enabled numbers may be recorded and transcribed for service quality

6. AI Services

Mesa uses artificial intelligence to handle phone calls and assist with reservations. While we strive for accuracy, AI-generated responses may occasionally contain errors. Restaurant owners should verify important reservations and information. Mesa is not responsible for errors made by the AI assistant, including incorrect reservation details or miscommunication.

7. SMS Communications

Mesa sends transactional SMS messages to guests on behalf of restaurants, including reservation confirmations, reminders, updates, and cancellation notices. Up to 5 messages may be sent per reservation. Message frequency varies based on your reservation activity.

By providing a phone number during the reservation process, guests consent to receive these reservation-related text messages from Mesa on behalf of the restaurant. Consent is not a condition of making a reservation or purchasing any goods or services. We do not send marketing or promotional messages.

Standard message and data rates may apply. Reply STOP to any message to opt out at any time. Reply HELP for help or contact us at support@mesacall.com.

Carriers are not liable for any delayed or undelivered messages.

8. Intellectual Property

The Mesa platform, including its design, code, features, and branding, is owned by Mesa and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of our service without written permission.

9. Limitation of Liability

Mesa is provided “as is” without warranties of any kind. We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to lost reservations, missed calls, or business losses. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

You may stop using Mesa at any time. We may suspend or terminate your access if you violate these terms or for any other reason at our discretion. Upon termination, your right to use the service ceases immediately.

11. Changes to Terms

We may modify these terms at any time. Material changes will be communicated through the platform or via email. Continued use of Mesa after changes constitutes acceptance of the updated terms.

12. Governing Law

These terms are governed by the laws of the United States. Any disputes arising from these terms or your use of Mesa shall be resolved in the courts of the applicable jurisdiction.
